Terms and Conditions
These Terms and Conditions (“Terms”) govern all purchases made on winesandspirits.ch and all commercial relations between Wines & Spirits SA, headquartered at Graveyre 8, 1312 Eclépens, Switzerland (hereinafter “the Seller”), and any customer placing an order (hereinafter “the Buyer”). By placing an order, the Buyer expressly accepts these Terms in full.
1. Products and Prices
All product prices are displayed in Swiss Francs (CHF), per unit, excluding Swiss VAT.
For deliveries within Switzerland, Swiss VAT at 8.1% is added at checkout. For deliveries outside Switzerland, the sale qualifies as an export under Swiss tax law (Art. 23 LTVA) and is exempt from Swiss VAT. The Buyer, as importer of record, remains responsible for any VAT, customs duties, and local taxes applicable in the country of destination (see Section 6).
Prices may be updated at any time and apply as listed on the day the order is placed.
Our product list is subject to prior sale. Certain items are available in very limited quantities, and the Seller reserves the right to allocate stock at its discretion. In the event that an ordered product becomes unavailable, the Seller will inform the Buyer promptly and propose a refund or a comparable alternative.
2. Orders and Payment
Orders are payable in advance. Accepted payment methods include credit card (via Stripe), PayPal, Twint, and bank transfer.
For regular customers, payment by invoice within 30 days of order may be accepted, subject to prior written agreement with the Seller. The goods remain the exclusive property of Wines & Spirits SA until full payment of the invoice has been received (retention of title clause under Swiss law).
3. Shipping within Switzerland
Shipments within Switzerland are sent via Swiss Post Priority or Vinolog. Bottles are placed in protective packaging for every parcel. Depending on scheduled delivery rounds, your order may be delivered directly by our courier; in this case, we will contact you by phone in advance to confirm your availability.

Customers wishing to collect their order in person must book an appointment in advance by email. Please note that our stock is stored at a separate climate-controlled facility and not at our Eclépens office.
4. Shipping to Europe
Shipments to the following European destinations are available through our standard service: Germany, Austria, Belgium, Spain, France, Italy, Liechtenstein, Netherlands, Poland, Portugal, Czech Republic, and United Kingdom.
Shipments are sent via DPD, fully insured, and delivered against signature. Delivery time is typically 3 to 7 business days.

5. Shipping Worldwide
Shipments to destinations outside Switzerland and the European countries listed above are available for most countries.

For quantities exceeding 18 bottles or destinations not covered by standard rates, please request a custom quote by email at info@winesandspirits.ch before ordering. Such orders are payable in advance by bank transfer.
Delivery time for worldwide shipments is typically 5 to 10 business days.
6. Customs, Duties and Taxes (International Orders)
For all shipments outside Switzerland, the Buyer is considered the importer of the products concerned. Accordingly:
- All customs duties, import taxes, VAT applicable in the destination country, and any other local charges are at the sole expense of the Buyer, payable on receipt of the parcel.
- It is the Buyer’s responsibility to complete any formalities and obtain any authorizations required to import alcoholic beverages into the destination country.
- The Buyer is responsible for ensuring that the products comply with the legislative and regulatory requirements of the country of destination.
Wines & Spirits SA declines any liability arising from customs refusal, import restrictions, or additional charges applied by local authorities.
7. Breakage, Loss and Transport Risks
Bottles are placed in professional protective packaging and all shipments are insured and delivered against signature.
The Buyer must inspect the parcel immediately upon delivery. Any visible damage, breakage, or discrepancy must be reported to the courier at the moment of delivery (where applicable) and to the Seller in writing at info@winesandspirits.ch within 5 business days of receipt, with supporting photographs.
Claims received after this period will not be accepted. Wines & Spirits SA declines any liability for breakage, loss, or theft reported after this delay.
8. Returns and Refunds
Products correctly delivered and conforming to the order cannot be exchanged or returned, given the nature of the products (rare, allocated, and collectible alcoholic beverages).
No returns are accepted on beers and meads, regardless of circumstance.
Corked or technically defective wines are not automatically replaced; any such claim must be submitted with photographic evidence within 5 business days of receipt and will be reviewed on a case-by-case basis at the Seller’s discretion.
Where a return is exceptionally agreed by the Seller in writing, the cost of return shipping is at the Buyer’s expense, and the products must be returned unopened, in their original packaging, within 10 business days of receipt.
9. Legal Drinking Age
By placing an order, the Buyer confirms being at least 18 years of age and of legal drinking age in their country of residence.
Wines & Spirits SA complies strictly with Swiss federal law on alcoholic beverages (LAlc) and reserves the right to refuse any order where reasonable doubt exists regarding the age or identity of the Buyer.
10. Data Protection
Wines & Spirits SA complies with the Swiss Federal Act on Data Protection (revised FADP / nLPD, in force since 1 September 2023) and applicable EU GDPR provisions where relevant.
Personal data voluntarily provided by the Buyer is stored securely and used exclusively to process orders, provide customer service, and, subject to the Buyer’s consent, send marketing communications. The Buyer may at any time request access, correction, or deletion of their personal data by writing to info@winesandspirits.ch.
Personal data is never sold or transferred to third parties for marketing purposes. Data may only be disclosed to third parties where strictly necessary for order fulfilment (e.g. shipping carriers) or where required by Swiss law, court order, or judicial decision.
11. Intellectual Property
All content published on winesandspirits.ch (texts, product descriptions, photographs, tasting notes, logos, and graphic identity) is the exclusive property of Wines & Spirits SA or is used under license. Any reproduction, in whole or in part, without prior written authorization is prohibited.
12. Governing Law and Jurisdiction
These Terms and all relations between the Buyer and Wines & Spirits SA are governed exclusively by Swiss law, to the express exclusion of the United Nations Convention on Contracts for the International Sale of Goods (Vienna Convention, 1980).
The exclusive place of jurisdiction for any dispute is Lausanne, Switzerland.
